- It may determine that the origin of the fire was not the particular product insured by the carrier or manufactured by the self-insured thereby eliminating liability.
- It could determine that the loss was of incendiary origin thereby implicating the insured and voiding the insurance policy.
- It may determine that the cause was an individual or product who has insurance thereby providing for subrogation recovery for the loss.
Timothy Lynch has significant experience in all three of these. He has represented a number of carriers in claims beginning with the investigation at the scene working with fire department investigators, engineers, and professional photographers and other experts, through the pre-litigation statement phase, to trials and appeals. He has handled a large number and tried to a jury six first party actions involving arson and insurance fraud. He is a 10-year member of the board of directors and an instructor at the annual training programs for the Alaska Association of Fire and Arson Investigators. He has attended training programs put on by State Farm Fire & Casualty, the Oregon Fire Marshals Office and other public agencies. He has represented a number of carriers in claims beginning at the scene investigation and statement under oath stages through successful jury trials and appeal.
